AI Rescues Company from a Two-Year Legal Nightmare

Tyler Tringas, the founder of Calm Company, shared how artificial intelligence rescued his small firm from a “two-year nightmare of litigation.” He offered several insights on effectively utilizing AI.

Tringas identified several challenges within the U.S. legal system. He pointed out that even when a company wins in court, it cannot recover legal expenses due to the «American Rule.» Defense costs often exceed $1 million, while 98% of cases end in pretrial settlements, as defendants must choose between guaranteed settlement costs and the risks of continuing with litigation.

Additionally, judges rarely dismiss cases due to the Motion to Dismiss rule. They accept all allegations of the plaintiff as fact and only reject cases based on technical errors, such as statutes of limitations.

Lastly, the Summary Judgment process requires no disputed facts, a nearly impossible standard in real disputes. For instance, if the parties disagree on the contents of negotiations, the case automatically moves to trial.

In Delaware, the author encountered a “ridiculous” lawsuit. Initially, he handed the case over to lawyers, but their conventional approach led to the expenditure of hundreds of thousands of dollars on formal procedures, such as document collection.

As the team became bogged down in analyzing thousands of pages of contracts, emails, and other documents, they decided to implement AI for automation. The tool identified key clauses in contracts, contradictory testimonies, and inconsistencies in the plaintiff’s position. It revealed that the accusations were based on out-of-context phrases and uncovered emails that contradicted the plaintiff’s claims. This provided leverage for negotiations in court and saved the firm hundreds of hours of work.

For initial document analysis, they used the Legal Robot tool, while AI from Casetext handled precedent research. However, the lawyers double-checked the AI’s findings to mitigate the risk of «hallucinations.»

Ultimately, the case was concluded on favorable terms after two years of struggle. The AI didn’t reduce costs but ensured the firm’s victory.

“If your business can’t afford to spend $500,000 on lawyers—act like a founder: seek leverage, rather than following standard procedures. AI is your ally here, but not a ‘magic pill,'» Tringas wrote. He believes that for small businesses, AI acts as a “great equalizer,” enabling them to compete against corporations with massive legal budgets. However, the success of implementing these tools depends on the combination of technology and the founder’s personal involvement.

Meanwhile, the legal AI startup Harvey, known for its specialized solutions for law firms, announced that it has integrated foundational models from Anthropic and Google into its platform, rather than relying on OpenAI models. The goal is to provide users with higher-quality results and greater control over AI tools. The integration of Claude and Gemini will enable Harvey to automatically direct tasks to the most suitable model, improving the quality of outcomes for lawyers.
